Roll Call – Councilor Jacobs, McNabb, Hunter, Dempsey, Mayor Lattimore - Present.  .

City Staff Present – John Salomone, City Manager; Tom Leone, Corporation Counsel; Debra McCormick, City Clerk; Beatrice O’Hora, Comptroller; Police Chief Gary Giannotta, Fire Chief Mike Quill; Bill Lupien, Superintendent of Engineering Services.

Presentations and Proclamations
Mayor Lattimore introduced Joe Camardo, from the Italian Heritage Society.  Mr. Carmardo read a statement.

Public Announcements – Clerk read.

City Managers Report – None.

Public to be Heard –
Connie Laxton, parent of skateboarder – spoke to Council to ask them not to increase the no skate zone.  She also commended the young people in attendance.

Mike Smart, S. Marvine St. – spoke against the expanded no skate zone.

John (no last name given) 19 Hurds Circle, spoke against the no skate zone.

Will Aldrich, 93 E. Genesee St. – spoke against the no skate zone.

Councilor Dempsey commented.

Councilor Jacobs commented.

Mayor Lattimore commented.

Councilor Dempsey motioned to table the 2 ordinances on the agenda regarding the skate zone.  He was seconded by Mayor Lattimore.  Mayor Lattimore called for a vote.  Vote: Councilor Jacobs, McNabb, Hunter, no; Councilor Dempsey and Mayor Lattimore yes.  Not Tabled.  

Corporation Counsel Tom Leone stated that the vote to table is out of order and voided.  

Ms. Laxton spoke again against the no skate zone.
Will Aldrich spoke against the expanded zone.

Joe, (no last name) 166 Seymour St. – spoke to tell Council that BMX bikers have no place to go either.

Brandon Rendo, 1 Orchard St. spoke against the no skate zone expansion.

Mark Taylor, 5611 McLeland Dr., Fleming spoke in opposition to the no skate zone.

Mrs. Picciano, parent of skateboarder spoke in opposition to the ordinance.

Mike Ryan spoke in opposition of the ordinance.

Report of City Officials –  None

Committee Report –
Mayor Lattimore commented on pension costs for the police and fire.  The City Manager responds.

Ordinances –
Ordinance #1 of 2004 authorizing an amendment to the Code of the City of Auburn Chapter 234, entitled “Public Conduct”.     Vote: Councilor Jacobs, McNabb, Hunter,-yes; Councilor Dempsey and Mayor Lattimore – no.  PASSED

Ordinance #2 of 2004 authorizing amendment to the Code of the City of Auburn, Chapter115 entitled “Bicycles”.    Vote: Councilor Jacobs, McNabb, Hunter, yes; Councilor Dempsey and Mayor Lattimore – no.  PASSED

Resolutions –
        
Sewer-Water Repair/Replacement Resolution #34 of 2004 authorizing the financing of a water line replacement under the Sewer-Water Repair/Replacement Program. Vote: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Lattimore – aye.  PASSED

Financial Resolution #35 of 2004 authorizing an amendment to the 2003-2004 General Fund Budget to account for both an increase in revenue and an increase in expenses due to the award of a Federal Grant for the Fire Department. Vote: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Lattimore – aye.  PASSED




Council Resolution #36 of 2004 authorizing the Historic Resources Review Board to do a Request for Proposal (RFP) for professional services for reconnaissance level study of the entire City and completion inventory of potential historic properties in the City of Auburn. Vote: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Lattimore – aye.  PASSED

Change Order Resolution  #37 of 2004 authorizing Change Order #3 to F. Rizzo Construction, Inc., for the sanitary sewer improvements to the  Genesee Street reconstruction project currently under way.  Vote: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Lattimore – aye.  PASSED

Second Public to be heard –
Sandy Craner, Business Improvement District Executive Director spoke to thank Council for supporting the downtown businesses with the ordinance.

Other Business –  
Councilor Hunter commented on West Genesee St. construction and road work being done on Columbus St.

Mayor Lattimore commented on signs he would like to see on the Arterial welcoming Bass Pro shoppers to the area.
